TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHEAPRX.AI, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY RELIANCE ON PRICING INFORMATION DISPLAYED ON THE SERVICE; (C) ANY TRANSACTIONS WITH OR CONDUCT OF THIRD-PARTY PHARMACIES, COUPON PROGRAMS, OR SERVICES; (D) ANY MEDICATION DECISIONS MADE BASED ON INFORMATION FOUND ON THE SERVICE; (E) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (F) ANY OTHER MATTER RELATING TO THE SERVICE.
IN NO EVENT SHALL THE MAXIMUM AGGREGATE LIABILITY OF CHEAPRX.AI FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED ONE HUNDRED DOLLARS ($100.00 USD).
You agree to indemnify, defend, and hold harmless CheapRX.AI, its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any rights of a third party.
CheapRX.AI does not collect, store, or transmit protected health information (“PHI”) as defined under the Health Insurance Portability and Accountability Act (“HIPAA”). Drug searches performed on the Service are anonymous and are not linked to any individual identity. CheapRX.AI is not a covered entity or business associate under HIPAA.

CheapRX.AI reserves the right to modify, amend, or update these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located within the United States, and you consent to the personal jurisdiction of such courts.
